Landreeve was instructed to advise a landowner who had granted an access easement to an electricity company. The electricity company had been using the access not only to get to their adjoining land but also as a works compound including welfare facilities, materials storage and even a security cabin.
The electricity company had been in occupation of the land for a number of months and, by the time of negotiations, had mostly vacated the site. We conducted a review of the easement and were able to confirm that the electricity company had exceeded their rights in the easement by setting up the compound.
We advised the landowner of their options and proceeded to negotiate a retrospective licence agreement with the electricity company. This regularised the position and ensured the landowner received a market rent for the use of their land and we recovered all of our costs from the electricity company.
