Landreeve was instructed to advise a landowner who had lost confidence in their current telecoms agent and was due at a case management hearing with the Upper Tribunal (Lands Chamber) the following week, having had legal proceedings brought against them by one of their telecoms tenants.
During our initial consultation, it quickly became apparent that the landowner had no legal representation. We advised the landowner to urgently allow us to put a legal team in place to vacate the hearing, allowing us time to negotiate with their tenant, saving them thousands in legal and court fees.
On further review, we identified that the telecoms site had in fact been carved out of the neighbouring development site, which was in the process of being sold. This enabled us to quickly build an argument to agree a 50% higher rent under the new agreement than the commencing rent under the old one.
